1. Description of Service
Pastella provides AI-powered photo restoration and video generation services. We use advanced artificial intelligence technologies to enhance image quality, colorize photos, and animate static images into video.
2. Generative AI Disclaimer
You acknowledge that the services provided are based on probabilistic AI models.
- Accuracy: We do not guarantee that the results will be 100% accurate, realistic, or free of artifacts. AI generation may occasionally produce unexpected or distorted results ("hallucinations").
- No Warranty: The service is provided "as is." We are not liable for any dissatisfaction regarding the aesthetic quality of the AI-generated content.
3. User Conduct & Acceptable Use
Strictly Prohibited Content:
To ensure a safe experience for all users and comply with App Store guidelines, you agree NOT to use Pastella to upload, restore, or generate content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
- Contains sexually explicit material, pornography, or nudity.
- Promotes violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Infringes on the intellectual property rights or privacy rights of others.
- Creates misleading or deceptive content ("deepfakes") of public figures, celebrities, or private individuals without their explicit consent.
Violation of this policy will result in the immediate termination of your access to the service and, if necessary, reporting to relevant authorities.
4. Intellectual Property
- Your Content: You retain all ownership rights to the photos you upload and the videos you generate. By using the service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the service to you.
- Our Technology: The Pastella app, its design, code, and underlying AI integration logic are the property of the developer and are protected by copyright laws.
5. Credits & Purchases
- Virtual Currency: Pastella operates on a "Credit" system. Credits are virtual items with no real-world monetary value.
- Non-Refundable: All purchases of Credits are final and non-refundable, except as required by applicable law or Apple's Media Services Terms and Conditions.
- Expiration: We reserve the right to expire unused credits if your account remains inactive for a period exceeding 24 months.
6. Limitation of Liability
To the maximum extent permitted by law, Pastella and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the service.
- Any conduct or content of any third party on the service.
- Any content obtained from the service.
7. Third-Party Services
Our service utilizes third-party cloud infrastructure and AI providers to process your images. While we select reputable providers, we are not responsible for the availability or accuracy of these third-party services.
